1. Introduction

Before entering the Alias ‘Virtual World Builders Contest’ (the "Contest", “VWBC”), we kindly ask you to carefully review these terms and conditions.

By entering a submission to the Virtual World Builders Contest, you or your team (the “Participant”) agree to be bound by these Terms and Conditions. It is the Participant's responsibility to read and understand them fully. The Contest is organized by Alias (the "Organizer").

The Contest begins Monday March 11 2024 at 12PM GMT +0 and ends on the deadline Monday April 8 2024 at 12PM GMT +0 (“Contest Period’).

2. Eligibility

  1. Eligibility Criteria

    1. Participants must be at least 18 years old at the start of the Contest Period.

    2. Participants of all levels of experience are welcome.

    3. Entries can be submitted individually or as a team. All team members must individually meet all the eligibility requirements.

    4. Employees and contractors of the Organizer, a Contest sponsor or its affiliates, their immediate family members, and those living in the same household, are ineligible to participate.

    5. Eligibility for the Contest is exclusively available to individuals who are legal residents of jurisdictions where entering and participating in contests of this nature is legally permitted. It is the responsibility of the Participant to ensure their eligibility based on their local laws and regulations. Submissions from individuals residing in jurisdictions where participation in such contests is restricted or prohibited by law will not be accepted. We encourage potential Participants to verify their jurisdiction's stance on contest participation to ensure compliance.

3. How to Enter

  1. Registration and Entry

    1. Participants can register for, and enter, the Contest by completing the submission form at https://myalias.id/vwbc-submission

    2. All information submitted in the submission form must be accurate, including contact information that is up-to-date and valid.

    3. Submissions must be completed by the submission deadline, which is Monday April 8 2024 at 10PM AEST (12PM GMT, 7AM EST, 4AM PT).

    4. The Organizer reserves the right to close submissions at its discretion.

    5. Teams must select 'Team’ for the selection in the submission form titled ‘Submitting as:’, and also clearly specify the names (or creator names) and email addresses of all of the participants in the team in the dedicated box provided in the form. A team representative must submit the entry on behalf of the team. Failure to disclose any contributor may result in disqualification. If submitting on behalf of a team, and agreeing to these terms upon completing the submission form, you are confirming that all specified members in the team agree to all of the terms in these Terms & Conditions, in addition to the Organizer’s privacy policy.

  2. Submission Guidelines

    1. Participants must submit a digital file (or multiple digital files) via the submission form reachable at https://myalias.id/vwbc-submisision, meeting the requirements set out in the entry specifications set forth on the Organizer’s Contest webpage, reachable at https://www.myalias.id/vwbc, during the Contest Period.

    2. Submissions (a) must be completed by an eligible Participant; (b) must comply with the requirements set out in Section 4 of these Terms and Conditions (“Submissions”); and (c) must include all information requested in the submission form. All contact information provided must be current, accurate, and valid.

    3. Entries can be submitted in the following categories: Character Designs, VRM Avatar, and Scenes.

    4. The Organizer reserves the right to close submissions at its discretion.

    5. Only entries that are properly submitted will be reviewed by our judging panel and considered an official Submission.

4. Submissions

  1. General Eligibility and Originality

    1. All entries must be the original work of the Participant(s) and not infringe upon the rights of any third party.

    2. Entries must not contain illegal, obscene, indecent, defamatory content, or content that incites racial or ethnic hatred or violates privacy rights, or is otherwise objectionable.

    3. Work created as part of paid employment is not eligible.

    4. The use of AI-generated elements is strictly prohibited in submissions. For the purposes of this contest, 'AI-generated elements' are defined as any content or component primarily created by artificial intelligence or machine learning algorithms (e.g. generative art tools such as Midjourney, DALL·E, ChatGPT etc.) without significant human editorial oversight or creative input. This includes, but is not limited to, artwork, images, shapes, designs, and animations generated by AI tools. Participants are required to disclose any use of AI tools or algorithms, even if substantial human modification is involved. The Organizer reserves the right to request a detailed description of the creative process, including the extent of AI tool involvement, to ensure compliance with this rule.

    5. Participants are required to strictly adhere to all software licensing agreements and copyright laws during the creation of their submissions. Participants must comply with all applicable software regulations during the submission creation process. Failure to adhere may result in disqualification.

    6. Submissions must adhere to the provided technical specifications and themes set out within the sections for each category on the main contest page, reachable at https://www.myalias.id/vwbc.

    7. Multiple submissions are allowed, but each must be unique and meet all Contest requirements.

    8. Scenes have a strict upper limit of 8 entries per Participant. If more than 8 Scenes are submitted by mistake, the Participant may email the Organizer at hello@myalias.id to inform them which 3 to confirm as submissions to the Contest. It is the responsibility of the Participant to clarify.

    9. At its sole discretion, Organizer reserves the right to review submissions and take any necessary measures to ensure the integrity of the Contest.

5. Judging and Selection

  1. Judging Framework

    1. Winners will be selected by (1) a panel of judges appointed by the Organizer, and additionally via (2) a community voting mechanism (together making the “Judges”), as detailed in the Contest guide available at https://www.myalias.id/vwbc.

    2. The judging criteria will generally focus on creativity, originality, technical execution, and the quality of the work. However, specific criteria may vary between different categories of the Contest, as outlined in the Contest guide, reachable at https://www.myalias.id/vwbc.

    3. The Judges shall have absolute discretion in determining the winners and their decisions shall be conclusive and binding.

    4. In the event of Judges being unable to complete the judging process for any reason, the Organizer reserves the right to decide the winners of the Contest. It is the sole Discretion of the Organizer to decide whether the Judges are unable to complete the judging process for any reason.

  2. Selection

    1. Judging will occur for approximately 2 weeks after the submission deadline.

    2. The winners will be announced within approximately 1 week after the judging process has concluded.

    3. There will be 8 winners in total, comprising 1 x winners as selected by a panel of judges for the categories VRM Avatar, and Character Design, 2 x winners as selected by a panel of judges for the category Scenes, 1 x winners as selected by a community voting mechanism for the categories VRM Avatar, and Character Design, and 2 x winners as selected by a community voting mechanism for the category Scenes.

6. Prizes, Notification, and Delivery

  1. Prize Details and Conditions

    1. Winners in each category will receive a cash prize, with details specified in the Contest guide, reachable at https://www.myalias.id/vwbc. Winners will be contacted via the email address provided within their submission form to claim their prize.

    2. Winners of the Character Design category will also receive 1 VRM avatar designed in the likeness of their winning submissions.

    3. Prizes are non-transferable and must be accepted as awarded, with no substitutions or exchanges permitted, except at the Organizer’s discretion.

    4. Winners are liable and responsible for any taxes, fees, currency exchange costs, or other expenses associated with prize receipt and/or use. Organizer reserves the right to withhold and deduct any taxes and charges from any prize if and to the extent required by law.

    5. To claim a prize, winning Participants must submit all requested documents by a specified deadline, as indicated after being contacted by the Organizer and given a reasonable time to respond and provide necessary verification documents. Failure to respond timely or provide required information may result in disqualification and forfeiture of any associated prizes.

    6. Cash prizes will be delivered within 30 days of the winning Participant(s) completing the necessary claim processes outlined above.

    7. VRM avatar prizes will aim to be delivered within 60 days of the winning Participant(s) completing the necessary claim processes outlined above, although this timeline cannot be guaranteed. The Organizer will communicate directly with the relevant winning Participant(s) in the case of a delay.

    8. In the event of prize return or non-claim, the prize will be forfeited.

7. Intellectual Property

  1. General Terms for All Participants

    1. By submitting an entry, Participants warrant that their submissions are their original work, do not incorporate any AI-generated elements as defined in clause 4.1.4, and do not infringe on the intellectual property rights of any third party.

    2. Participants agree to indemnify, defend, and hold harmless the Organizer and their affiliates, officers, agents, employees, sponsors and partners from any liability, loss, claim, and expense, including reasonable attorney's fees, arising from the Participant's violation of these terms or any infringement of any intellectual property or other rights.

    3. Submissions must include clear disclosures of any third-party content used (including the third-party content used, including the name of the owner, the nature of the content, and how it was utilized in the submission) and must not infringe on any third-party intellectual property rights.

    4. Entries must respect privacy, publicity, intellectual property rights, and must not depict any third party without permission.

  2. Rights and Permissions for All Participants

    1. By submitting works to the Contest via the submission form, Participants retain ownership of their submissions but grant the Organizer a worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, adapt, publish, and display the submissions in connection with the Contest and for promotional purposes related to the Organizer's activities. This licensing is crucial for the Organizer to fully utilize the submissions for various purposes, including but not limited to marketing and promotional activities. This license includes the right to adapt, modify, and create derivative works for the purpose of showcasing the submissions, but not for commercial resale as standalone pieces.

  3. Rights and Permissions for All Contest Winners

    1. Winning Participants of the Contest, in addition to clause 7.2.1, grant the Organizer a worldwide, royalty-free, irrevocable, perpetual license to make the winning submissions available for free use (for example, but not limited to, using submissions to create content, post content containing submissions to any social media platform, generate income using the submissions via content made through the Organizers platforms or applications, ‘collect’ the submissions as part of their ‘owned’ collections on the Organizers platforms or applications) to any users of any of the Organizers applications or platforms who legitimately acquire the right to use the IP.

    2. Winning participants agree to the use of their name, likeness, and submission details for promotional purposes related to the Contest, unless prohibited by law.

    3. Winning submissions will be modified as required in order to be optimised for use on the Organizers platforms.

    4. Organizer commits to ensuring that the contributions of winning Participants are recognized appropriately whenever their work is used.

8. Indemnification

  1. Indemnification Clause

    1. Participants agree to indemnify, defend, and hold harmless the Organizer and its affiliates, officers, employees, agents, and successors from any claim, liability, loss, damage, cost, or expense, including reasonable legal fees, arising out of or in connection with their participation in the Contest.

    2. This includes any violation of these terms and conditions, infringement of intellectual property rights, or any other rights of any person or entity.

    3. It is the Participant's responsibility to ensure that their submission does not infringe on the rights of others and to bear the consequences of any such infringement.

9. General Conditions

  1. Contest Management

    1. The Organizer reserves the right to cancel, suspend, or modify the Contest at its sole discretion if events beyond its control, including but not limited to fraud, technical failures, force majeure events, computer virus infections, unauthorized interventions, governmental actions, natural disasters, pandemics, or any other events that corrupt or impair the integrity, security, fairness, or proper functioning of the Contest.

    2. Organizer disclaims responsibility for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or any equipment or programming associated with the Contest.

    3. Organizer reserves the right to disqualify any Participant, at its sole discretion, if they are found to be tampering with the entry process or the operation of the Contest. Organizer may prohibit a Participant from participating in the Contest or winning a prize if, determined in its sole discretion, Organizer has reason to believe Participant is attempting to undermine the integrity of the Contest by cheating, deception, hacking, or other unfair practices or intending to annoy, abuse, threaten or harass other Participants or Contest Sponsor representatives. Contest sponsor reserves the right to prosecute any fraudulent Participants to the full extent of the law.

    4. Organizer may, at its sole discretion, modify, suspend, or terminate the Contest and amend these terms and conditions without prior notice. Participants will be notified of significant changes.

10. Conduct

  1. Participants must conduct themselves in a manner that is respectful to all parties involved. Harassment or abusive behavior will result in disqualification.

11. Privacy Policy and Data Protection

  1. Personal Data Collection and Usage

    1. The Organizer is committed to protecting your privacy and ensuring the security of your personal data. Personal information collected during registration or participation, including but not limited to, name and email address, will be used exclusively for contest administration purposes, such as eligibility verification, communication with participants, and prize distribution. The Organizer adheres to the General Data Protection Regulation (GDPR) and other applicable data protection laws in processing personal data. Participants have the right to access, correct, delete, or transfer their personal information, or withdraw consent for its use, at any time by contacting the Organizer. Personal data will not be shared with third parties without participants' explicit consent, except as necessary for contest management or prize distribution.

  2. Data Rights and Transparency

    1. Participants have comprehensive rights over their data, including the right to access, correct, delete, or transfer their personal data, and to withdraw consent for data processing at any time.

    2. Organizer will not share personal data with third parties without explicit consent, except as necessary for Contest management or prize distribution.

  3. Publicity and Promotional Use

    1. By participating, you grant Organizer permission to use your name, likeness, photograph, and other relevant personal details for advertising and promotional purposes related to the Contest, without additional compensation, except where this is prohibited by law.

  4. Data Use Policy Acknowledgment

    1. By entering the Contest, Participants confirm understanding and acceptance of these terms regarding data protection and publicity. They also acknowledge the possibility of similarities between submissions and waive any claim against Organizer or fellow Participants arising from such similarities.

By agreeing to these Terms and Conditions, you also agree to the Organizer’s Privacy Policy, reachable at hthttps://www.myalias.id/privacy-policy.

12. Governing Law and Dispute Resolution

  1. General Provisions

    1. These Terms and Conditions, and any dispute arising from the Contest, are governed by the laws of the Republic of Singapore, without giving effect to choice of law or conflict of law principles.

    2. Organizer is not liable for any claims or damages arising from participation in the Contest, and Participants agree not to hold Organizer responsible for any such claims.

  2. Amicable Resolution

    1. Parties agree to first seek an amicable resolution through mutual consultation for any dispute arising out of or in connection with the Contest.

  3. Arbitration

    1. If an amicable resolution is not achieved, disputes will be settled under the Rules of Arbitration of the Republic of Singapore by arbitrators appointed according to those rules.

  4. Waiver and Severability

    1. Organizer’s failure to enforce any term of these Official Rules does not constitute a waiver of that or any other provision.

    2. If any provision is found to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

  5. Individual Dispute Resolution

    1. Disputes arising out of these Official Rules shall be resolved individually, without resort to any form of class action.

13. Liability Limitation and Disclaimer

  1. General Liability Limitation

    1. Organizer shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from or related to the Contest, except in cases of gross negligence or willful misconduct. This limitation applies to all forms of action, whether in contract, tort (including negligence), warranty, or otherwise, and is in effect unless prohibited by law.

  2. Contest Participation and Responsibility

    1. Organizer is not liable for any loss, damage, or injury resulting from participation in the Contest or from any Contest-related activity.

    2. Organizer will not be responsible for:

      1. Late, lost, misrouted, garbled, distorted, or damaged Submissions or communications, except if directly caused by Organizer's gross negligence or willful misconduct.

      2. Disruptions, injuries, losses, or damages caused by events beyond Organizer's control.

      3. Printing or typographical errors in any materials associated with the Contest.

    3. Receipt of entries may not be acknowledged, and proof of submission will not be deemed proof of receipt. Mutilated, lost, illegible, corrupted, or incomplete Submissions will be disqualified.Decision Finality and Compliance

  3. Decision Finality and Compliance

    1. By entering the Contest, Participants agree to be bound by these rules and acknowledge that the decisions of the Organizer, made in its sole discretion, including the interpretation and application of these Official Rules, are final and binding in all matters relating to the Contest.

    2. Participants must comply with applicable laws and regulations of their jurisdiction. Organizer is not obligated to modify these Official Rules due to laws, decrees, or regulations, except as stated within these rules.

  4. Website Use and Prize Conditions

    1. Organizer disclaims, to the fullest extent permitted by law, all liability for any damages or losses arising from access to or use of Contest-associated websites, downloading materials, or any prize-related issues. Prizes are awarded “AS IS” without any warranty, except where warranty cannot be excluded by law.

    2. Organizer is not responsible for any incorrect or inaccurate information, technical failures, unauthorized human intervention, or any damage to person or property caused directly or indirectly by Contest participation or prize receipt/use.

  5. Remedy for Submission Issues

    1. If a Submission is erroneously deleted, lost, or corrupted, the sole remedy for the Participant is the opportunity for another Submission, subject to the sole discretion of the Organizer, limitations of these Official Rules and applicable law.

14. Acknowledgement

By entering a Submission, Participants confirm that they have read, understood, and agreed to be bound by these Terms and Conditions, Privacy Policy, and any other related documents.
